Regulatory Compliance for Electronic Cigarettes and Vape Liquids

Specific regulatory and safety documentation for e-liquids and vaping products.

Overview

Why Electronic Cigarettes and Vape Liquids Require Specific Compliance

Your e-liquids are characterised by the presence of nicotine in various concentrations. Nicotine is an acutely toxic substance (by all three routes: inhalation, dermal, oral) and toxic to aquatic life with long-lasting effects. Because such products are sold to the general public — and are banned in some countries — they are more regulatory challenging than many other product types.

Placing them on the market therefore requires strict regulatory assessment and correct classification and labelling to ensure safe use. Note: placing such products on the market with false labels can result in criminal liability.

Regulatory framework

Key Regulations

CLP

Classification and labelling of e-liquid mixtures; nicotine and other hazardous components.

Poison centre notification

UFI/PCN for hazardous e-liquid mixtures in the EU.

SDS and labelling

Safety data sheets and product labels; customer and market requirements.

REACH

Substance restrictions and communication in formulations.

National requirements

Country-specific rules for nicotine and vaping products.

Practical challenges

Typical Compliance Challenges

  • Classifying nicotine-containing and nicotine-free mixtures
